General Terms and Conditions of Sale

1) GENERAL CONDITIONS

These “General Conditions” govern the terms and conditions of the products marketed by COIANO di Maestrelli Franco & C. s.s.a. All contracts for the sale of products by COIANO di Maestrelli Franco & C. s.s.a. (hereinafter “the Seller”) to third parties (hereinafter “the Buyer”) are governed by the following general conditions, which form an integral and substantial part of every offer, order, and order confirmation for the products.
The conditions of sale applicable to your order are those in force on the date of the order itself. Any conflicting or divergent purchasing conditions or other limitations imposed by the Buyer are not recognized unless expressly confirmed in writing by the Seller in the specific case.

2) PRICES

This agreement supersedes and replaces any prior agreements regarding prices. The prices listed on the website are inclusive of VAT and may be amended at any time. The prices applicable are those valid at the time of purchase as determined by the Seller.

3) ORDERS, RETURNS AND REFUNDS

All orders are accepted subject to approval by COIANO di Maestrelli Franco & C. s.s.a. as Seller. Returns of goods are not accepted without prior approval from the Seller.
Requests for returns and refunds must be sent by email to info@castellodicoiano.it no later than 7 days from the date of delivery. The email must include:

  • Buyer’s name
  • Product name
  • Quantity to be returned
  • Reason for the return

The Seller will review the request and, if approved, the parties shall agree on the collection of the goods.
Returns must be made in original, intact packaging (particularly the e-wine carton).
For wine bottle returns, the bottle must be properly sealed—not by hand; preferably, the contents should be transferred to a sample bottle and resealed with a crown cap.

The Seller will issue a credit note for returned goods at the purchase price. Refunds will be made via PayPal or bank transfer. Returns of partially empty or empty containers are not accepted (pursuant to DPR 915/82 and subsequent amendments).

4) TERMS AND METHODS OF PAYMENT

All payments must be made within the contractual terms and by the agreed methods. Payments are deemed completed only when the amount is definitively credited to the account of COIANO di Maestrelli Franco & C. s.s.a.

Online payments must be fast, simple, and secure. Currently, the following payment methods are available on our website:

  • PayPal;
  • Credit Card.

5) SHIPPING COSTS

Current shipping costs apply only to purchases made on www.castellodicoiano.it. Shipping costs are calculated per order, and orders are usually shipped in full.

6) SHIPPING AND DELIVERY TIMES

Shipping and delivery times are not exclusively dependent on COIANO di Maestrelli Franco & C. s.s.a. but also on the couriers used (currently GLS). Shipping usually occurs within 72 business hours from order processing.


Orders placed after 12:00 pm on Friday (or the day before a public holiday) will be processed on the next available business day. Delivery delays may occur during peak periods, generally mid-August or around the Christmas-New Year period, as GLS cannot guarantee usual delivery speed.

7) CLAIMS

Claims will be considered only if notified in writing immediately or at the latest within 7 days from delivery, including invoice number and date, packaging tracking numbers, and supported by documentary evidence, samples, and packaging inspection tickets. Any discrepancies, defects, or product anomalies must be reported by email to info@castellodicoiano.it.

8) FORCE MAJEURE

Cases of force majeure of any kind, unforeseen company difficulties, transport or shipping problems, war, terrorist acts, fires, floods, unexpected shortages of labor, raw materials or auxiliary products, energy shortages, strikes, lockouts, orders by authorities, or other impediments beyond the control of the obligated party, which reduce, delay, hinder, or prevent manufacture, shipment, delivery, or consumption of goods, shall relieve the parties from obligations for the duration and extent of the impediment.
If, due to force majeure, supply and/or delivery are delayed for more than eight (8) weeks, both parties shall be entitled to terminate the contract.

9) DISPUTES – JURISDICTION

The exclusive jurisdiction for any disputes between Seller and Buyer shall be the Court of Florence. The Seller is also authorized to enforce its rights at the Buyer’s location. If one or more clauses of these General Conditions are wholly or partially unenforceable or invalid, this shall not affect the validity of the remaining clauses or the unaffected parts of partially invalid clauses.

10) PERSONAL DATA PROCESSING

Pursuant to Italian personal data protection laws (Legislative Decree 196/2003), Buyer data shall be stored in archives to execute the order and comply with fiscal regulations. The Buyer may request changes, deletions, or information concerning their personal data at any time.
